This text aims to reflect on the relationship between Education and human and social law. To this end, it presents the reader with education in the ontological and historical capitalist perspective, indicating the main legal aspects of the right to education in Brazil. Thus, it is the result of a bibliographic research based on the theoretical-methodological framework of Historical-Dialectical Materialism. It is argued that education is a mediation between men and has the social function of transmitting fundamental knowledge and skills for human life, having a close relationship with the world of work and, therefore, mediated by the contradictions of this society. Finally, it should be noted that, despite advances in the legal sphere, the realization of education as a human and social right has historically established limits.
